Sexual Harassment Example
Harassment can occur in any place, the most common being harassment in schools and place of work. Most people are able to distinguish between good behavior and bad behavior, sexual harassment falls in the second category. However, what confuses most people is its line of boundary. While some men may see no harm in harmless flirting, the problem arises when it causes anger and fear in women when improperly done.
Let us take the sexual harassment example of a girl called Flora who was asked by her manager Harry for a date to discuss a business deal. Flora politely declines, but Harry makes it evident to her that refusal from her side would lead to negative repercussions and threaten her stature in the company. Harry here has undoubtedly committing sexual harassment. He is misusing his authority and position by forcing Flora to believe that she has no choice but to accept his indecent invitation, if not she better be prepared for negative consequences.
If this case reached the lawsuit, the verdict will depend on how well the case was argued by the attorneys and presented before the presiding jury. There is some grey area regarding harassment in the law. It is acceptable to remark or joke casually and people must be able to laugh it off or ignore it. But acceptable behavior varies from region to region and culture to culture.
The law states that every company must provide its employees with an environment that is free of menaces such as sexual harassment. It is mandatory by law for every business establishment to forbid the practice of sexual harassment in their policy. Depending on the nature, severity and the past reputation of the offender the company can impose penalty for violation of company policy. The penalty could include demotion, suspension, reprimanding, termination of services or reduction of pay. The company also needs to ensure the victim of protection in case the violator retaliates or seeks revenge for making a formal complaint against him.
If Harry was found guilty he would have been asked to formally apologize to Flora either verbally or in writing and could even be asked to undergo a counseling session. He would have to forego a pay reduction for three months and if caught violating the act the second time his services would immediately be terminated.
